Definitions
FISITA (UK) Limited
The provider of the web site: fisitajobs.com
Client
The person(s), company or business to whom the services are provided.
End Client
The person(s), company or business to whom the Client(s) services are
provided.
Principal
fisitajobs.com's main Client.
Registered User
The person who submitted their CV to fisitajobs.com and whose details are
set out within the CV.
Advertisement
Any advertising material or image supplied by a client for display on the
fisitajobs.com web site.
1.0 - General
1.1 By registering or submitting details to fisitajobs.com (both Client and
Registered User) I hereby state that I have read the fisitajobs.com terms
and conditions and agree with the rules set out governing the use of the
site.
2.0 - Clients Responsibilities
2.1 The Client enters into the Contract as the Principal, notwithstanding
that the Client may be an Advertising Agent or an Agency ultimately acting
as Agent for an end client and as principal, warrants that it is authorised
by the end client to place advertisements.
2.2 The Client shall comply with the provisions of the Data Protection Acts,
1984 and 1998 in relation to all fisitajobs.com's Registered User's details.
2.3 It is the responsibility of the Client to take up references and to
satisfy itself regarding the accuracy, availability, suitability, integrity
and reliability of all Registered Users whose resumes are provided by
fisitajobs.com.
All and any subsequent dealings between the Client and any Registered User
are the responsibility of the Client.
2.4 The Client shall obtain permission from the Registered User prior to
submitting their resume to any Client.
2.5 The Client shall not transmit or distribute any resume or other
information received from fisitajobs.com to any person(s), company or
business other than for the purpose of finding employment for those
Registered Users as set out in these terms and conditions.
3.0 - fisitajobs.com Responsibilities
3.1 fisitajobs.com will host advertisements supplied by the Client on its
web site, in the form and format agreed and for the fees set out in the
contract.
3.2 The client shall provide fisitajobs.com advertisements in the format set
out in the contract.
3.3 Vacancy Alerts will be sent out via email to Registered Users matching
the vacancy requirements once per day.
3.4 Vacancy advertisements will remain live on the site for the specified
period. Clients may also remove Vacancy advertisements at any time.
3.5 Vacancy advertisements may only contain details of one vacancy.
3.6 fisitajobs.com cannot guarantee the number of impressions a banner
advertisement will receive.
3.7 Banner advertisements must be supplied in the agreed format, set out in
the contract. Any additional work needed to artwork will be charged to the
Principal.
3.8 The availability of banner space throughout the site is not guaranteed,
and is entirely at the discretion of fisitajobs.com.
3.9 Clients may cancel any fisitajobs.com service in writing. Any cancelled
services by clients will be charged at the full rate.
3.10 fisitajobs.com reserves the right to decline, amend or suspend any
advertisement received.
4.0 - Registered User Services
4.1 fisitajobs.com will make Registered Users resumes available to Clients,
who have purchased the appropriate account package, for the purposes of
online resume searches. The service is subject to any instruction from
Registered Users concerning the availability of their details.
4.2 Resumes are made available to agencies and employers solely for the
purpose of securing suitable employment. fisitajobs.com makes no guarantee
whatsoever to the availability or suitability of Registered Users for
employment.
4.3 fisitajobs.com cannot guarantee the number of resumes available at any
given time.
5.0 - Payment for Services
5.1 Payment is due within 30 days of the invoice.
5.2 All prices quoted are exclusive of UK Value Added Tax which shall be
added at the applicable rate.
6.0 - Governing Law and Jurisdiction
6.1 These terms and conditions are governed by the laws of England and the
parties submit to the jurisdiction of its courts. |
